Subscription Agreement

CryptoTrend provides automated cryptocurrency market analysis tools, including multi-timeframe scanners, Relative Strength Index (RSI) data, market sentiment indicators, educational content (CryptoTrend Academy), and third-party exchange comparisons.

Cryptocurrency trading carries substantial risk and can lead to the loss of your entire capital. You acknowledge and agree that you use our services, data, and tools completely at your own risk. You should perform your own research (DYOR) and consult with a licensed financial professional before making any investment decisions.

By using the Services, you represent and warrant that:

• You are at least 18 years of age or the legal age of majority in your jurisdiction.
• You have the legal capacity and authority to enter into these Terms.
• You are not a citizen or resident of, or located in, any country subject to US comprehensive economic sanctions or trade embargoes (e.g., Cuba, Iran, North Korea, Syria, Crimea, Donetsk, and Luhansk regions).
• Your use of the Services complies with all applicable local, state, national, and international laws, regulations, and guidelines, including but not limited to anti-money laundering (AML) and financial markets regulations.

CryptoTrend offers premium features, customized tracking, and advanced scanner data under a paid tier ("Pro Plan").

Subscription Fee: Paid features are billed on a recurring basis (monthly or annually) as selected by you at checkout. All prices are listed in US Dollars (USD) or equivalent cryptocurrency values, exclusive of applicable taxes.

Free Trial: We may offer a 7-day free trial. If you do not cancel before the end of the trial period, your selected payment method will be charged automatically for the subsequent billing cycle.

Payment Processors: Payments are processed securely via third-party providers (including, but not limited to, Credit/Debit cards via Visa/Mastercard or decentralized crypto payments via Helio). By purchasing, you authorize us and our processors to charge your selected account. We are not responsible for any errors or failures caused by third-party processors.

No Refunds: To the maximum extent permitted by applicable law, all subscription purchases and renewals are final and non-refundable. You may cancel your subscription at any time to prevent future billing, and you will retain access to the Pro features until the end of your current billing period.

Unless otherwise indicated, the Site and Services, including all source code, databases, software, algorithms, data structures, website designs, audio, video, text, charts, graphics, and educational materials (collectively, the "Content") are owned or licensed by Phenix Digital Trading LLC, and are protected by copyright, trademark, and other intellectual property laws of the United States and international conventions.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site strictly for your personal, non-commercial use. Any unauthorized extraction, scraping, reverse-engineering, duplication, or redistribution of the data or scanner outputs without express written consent from us is strictly prohibited.

The Site contains hyperlinks and affiliate links to third-party services, including centralized cryptocurrency exchanges (e.g., Bybit, Bitget, Binance, OKX, KuCoin), hardware/crypto wallets, and crypto credit card providers.

You acknowledge that Phenix Digital Trading LLC may receive affiliate commissions or compensation from these third-party platforms for user referrals. We do not control, endorse, monitor, or guarantee the services, security, or legal compliance of these external entities. Your interactions, deposits, trades, or engagements with any third-party platform are governed solely by their respective terms and conditions, and you bear all associated risks.

THE SITE AND THE SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. YOU AGREE THAT YOUR USE OF THE SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICES AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY, RELIABILITY, OR COMPLETENESS OF THE SITE'S CONTENT, MARKET DATA, INDICATORS, SENTIMENT SCALES, OR THE CONTENT OF ANY WEBSITES LINKED TO THIS SITE. WE ASSUME NO LIABILITY OR RESPONSIBILITY FOR ANY (1) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT AND DATA, (2) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR SERVICES, (3) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (4) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SITE, OR (5) ANY LOSS OF FUNDS, TRADING LOSSES, OR LIQUIDATIONS INCURRED BY YOU AS A RESULT OF MARKET MOVEMENTS.

IN NO EVENT WILL PHENIX DIGITAL TRADING LLC, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SITE OR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE THREE (3) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability — in such cases, the above limitations apply to the fullest extent permitted by law.

You agree to defend, indemnify, and hold harmless Phenix Digital Trading LLC, its subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees and expenses, made by any third party due to or arising out of: (1) your use of the Services; (2) a breach of these Terms of Service; (3) any breach of your representations and warranties set forth in these Terms; or (4) your violation of the rights of a third party, including but not limited to intellectual property or regulatory rights.

These Terms and your use of the Site are governed by and construed in accordance with the internal laws of the United States of America, without regard to its conflict of law principles.

Any legal action, suit, or dispute arising out of or relating to these Terms shall be settled exclusively and bindingly through individual, non-class arbitration conducted in accordance with the commercial rules of the American Arbitration Association (AAA), or within the state or federal courts designated by Phenix Digital Trading LLC in the United States. You explicitly waive any right to a jury trial or participation in class actions.

We reserve the right to change, modify, or remove the contents of the Site or these Terms at any time or for any reason at our sole discretion without notice. Updates will be indicated by the "Last Updated" date at the top of these Terms.

We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Site or Services.
